Ruling in Gray case set for Monday

Convicted murderer Ricky Jovan Gray is scheduled to return to Culpeper County Circuit Court Monday to hear a ruling on a defense motion requesting information related to the cooperation of a witness for the prosecution.
Accused of killing 37-year-old Reva resident Sherri Warner on Dec. 18, 2005, Gray already faces a death sentence for killing a family of four in Richmond on Jan. 1, 2006.
At a March 12 hearing, Judge John R. Cullen ruled against the prosecution’s motion to allow testimony from Timothy Thomas, a Cumberland County prison inmate. Thomas testified at a February hearing that Gray’s girlfriend, Ashley Baskerville, implicated Gray in Warner’s death.
However, Cullen ruled that the commonwealth had not established Thomas’s statements as reliable, saying a “mental or physical impairment” may prevent Thomas from establishing an accurate timeline of the events in question.
Cullen also noted that Thomas insists Baskerville confided in him a month before the crime occurred. Gray is also accused of killing her two weeks later.
A 10-day jury trial is scheduled to begin Sept. 29.
